7. Limitation of Liability

To the fullest extent permitted by law, Gestell shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Use or inability to use the Service;
• Unauthorized access to or alteration of your transmissions or data;
• Statements or conduct of any third party on the Service;
• Any other matter relating to the Service.

In no event shall Gestell‘s total liability to you for all claims arising out of or related to the Service exceed the amount you have paid to Gestell, if any, in the last twelve months.

You agree to defend, indemnify, and hold harmless Gestell and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including legal fees and costs, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Gestell is established, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located within that jurisdiction.

Gestell reserves the right to modify or replace these Terms at any time. We will provide notice of these changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Entire Agreement

These Terms constitute the entire agreement between you and Gestell regarding your use of the Service and supersede any prior agreements between you and Gestell.
